The rules governing access to Donoa, fundraiser creation, donations, and the general use of the platform.
Purpose and scope
These Terms of Use govern access to and use of the Donoa platform, available at donoa.app, operated by DONOA Sarl.
They apply to anyone using the platform, whether as a visitor, creator, donor, commenter, or user of an authenticated area.
These terms complement the legal notice, the privacy policy, and the cookie policy.
Acceptance of the terms
What counts as acceptance
- creating an account on Donoa;
- publishing or editing a fundraiser;
- making a donation through the platform;
- continuing to use Donoa beyond simple browsing.
By using Donoa, the user acknowledges having read these terms and agrees to comply with them in full.
If the user does not agree with these terms, they should not use the platform.
Service description
What Donoa enables
- create and publish personal, charitable, community, or entrepreneurial fundraisers;
- receive donations through the payment methods enabled on the platform;
- share a fundraiser, track its progress, publish updates, and engage with supporters;
- publicly browse fundraisers, creator profiles, comments, and visible contributions.
Donoa acts as a technical intermediary between creators, donors, and payment providers. The platform is not a party to the funded project itself.
Donoa does not guarantee the success of a fundraiser, the completion of a project, or the final use of funds by a creator.
Registration and user account
Registration requirements
- be of legal age or have the required legal authorization when applicable;
- provide accurate, complete, and up-to-date information;
- use a valid and accessible email address;
- comply with these terms and the platform rules.
Security and checks
- the user is responsible for keeping credentials confidential;
- they must notify Donoa promptly in the event of unauthorized access or suspected fraud;
- some sensitive actions may require additional information, documents, or verification checks.
Fundraisers and publication
5.1 Publishing a fundraiser
The creator must publish a fundraiser that is honest, clear, and consistent with its stated purpose. Any text, visuals, videos, or documents used must be accurate and lawfully usable.
The creator remains solely responsible for the promises made, the legality of the fundraiser, and the use of the funds in line with the public description.
5.2 Moderation and visibility
Donoa may moderate, suspend, close, unlist, hide parts of, or remove a fundraiser when content or behavior breaches these terms, applicable law, platform safety, or user trust.
A fundraiser that has already been published may remain accessible by direct link even if it no longer appears in listings or no longer accepts donations.
Donations and payments
Payment processing
Donations are processed through the payment methods and providers made available on each fundraiser. Depending on the case, this may include local payments, foreign-currency payments, crypto payments, or manual bank transfers.
Donors are responsible for reviewing the payment details, selected amount, and applicable currency before completing payment.
Except in cases of fraud, manifest technical error, legal obligation, duplicate payment, or payment-provider decision, a donation is generally final once confirmed.
During checkout, donors may choose to leave an optional tip to support Donoa. This tip is optional and distinct from the amount allocated to the creator.
Pricing and fees
The Donoa principle
- 0% commission charged by Donoa on the donation amount intended for the fundraiser;
- no subscription fee and no sign-up fee to open a fundraiser;
- external fees may still apply depending on the payment method, bank, provider, or currency;
- any tip left to Donoa remains fully optional.
Intellectual property
Rights owned by Donoa
The platform, its brand, interface, design, texts, code, databases, and graphical assets are protected and remain the exclusive property of Donoa or its partners.
Any unauthorized reproduction or use is prohibited.
Published content
By publishing a fundraiser, the creator authorizes Donoa to host, display, reproduce, and distribute that content as needed for the service and for reasonable promotional purposes related to the fundraiser and the platform.
The creator warrants that they hold the necessary rights to the uploaded content.
Liability
Donoa makes reasonable efforts to ensure platform availability, security, and continuity, but does not guarantee uninterrupted service or the total absence of errors.
To the extent permitted by law, Donoa is not liable for indirect damages, temporary service interruptions, user-published content, or the way creators ultimately use the collected funds.
Creators remain solely responsible for the legality, accuracy, and execution of their fundraiser.
Prohibited conduct
- publish fraudulent, misleading, or false content;
- impersonate a person or organization;
- use the platform for money laundering, fraud, or unlawful activity;
- harass, threaten, intimidate, or discriminate against other users;
- attempt to bypass, attack, or compromise Donoa's security;
- collect or exploit other users' personal data without lawful basis or consent.
Termination and suspension
By the user
A user may request account closure by writing to help@donoa.app, subject to the completion of ongoing operations, applicable legal duties, and any required checks.
By Donoa
Donoa may suspend or terminate an account, freeze specific actions, or restrict access to the platform in case of breach of these terms, proven or suspected fraud, security risk, request from a competent authority, or operational or legal necessity.
Changes to the terms
Donoa may update these Terms of Use at any time in order to reflect legal, technical, operational, or commercial changes affecting the platform.
New versions become applicable upon publication and, where relevant, after users are informed by email, in-app notice, or a message displayed during a subsequent visit.
Applicable law and disputes
These Terms of Use are governed by the laws of the Republic of Benin, subject to any mandatory provisions that may protect certain users.
In the event of a dispute, the parties will first seek an amicable solution. Failing that, the matter may be brought before the competent courts within the jurisdiction of Donoa’s registered office.
